COMMERCIAL LITIGATION PRACTICE

CONSTRUCTION

Our commercial litigation practice concentrates on the representation of architects and engineers and other professionals in construction litigation disputes. Our extensive experience in the construction arena has benefited all our clients in other commercial litigation disputes. With eight experienced attorneys, we are capable of handling both small matters to large multi-party cases.

Litigation, Arbitration and Mediation

Our lawyers are often selected by design professionals and their insurers for aggressive defense of their professional malpractice claims. We understand that professional malpractice claims oftentimes involve personal attacks on our clients' business reputations and viability. Our practice has focused on the specialized nature of these claims and gives us in-depth experience on a broad range of project types.

You receive the benefit of our many years of representing design professionals. Each client gets the benefit of experienced trial attorneys who can translate and simplify technical A/E issues into a persuasive, common sense approach to resolving the claim, whatever its nature.

Lee & McShane's Contruction Team is aggressive and determined in response to the special needs of construction industry professionals and other companies involved in the construction industry. We provide legal advice on a broad array of issues including general business matters, litigation and risk management, claims, mechanic's liens in Maryland, Virginia and the District of Columbia and personnel issues. We especially are familiar with indemnification clauses, AIA contracts and worker injury law suits.

The Team's focus is assisting construction corporations in managing the risks of doing business in the contentious construction arena. As a way to avoid costly litigation, our lawyers always consider creative and innovative alternative dispute resolution procedures. We are skilled at persuading opponents to agree to mediation and arbitration -- whenever those methods promise a cost-effective solution.

Because we are concerned with your bottom line, we will ask you to be an active partner in the handling of your case. By keeping you constantly informed, we can focus on the critical issues and make decisions efficiently and expediently. We will also work with you during problem projects, behind the scenes, to identify any legal issues and cut them off early.

Through our depth of experience in multiple disciplines, we strive to provide our clients with a broad range of legal services from commercial litigation to business transactions to employment matters.

Our attorneys are frequent speakers and writers in the construction area. In addition, because of our experience, we are often asked to mediate disputes or sit as arbitrators. The firm is an associate member of the Consulting Engineers Council of Metropolitan Washington and the DC and Potomac Valley AIA chapters. Members of the team also are active in the ABA Forum on Construction.
