Government Contracts - contract, bid protest disputes and other matters

Over the past 20 years, Lee & McShane attorneys have litigated government contract disputes and bid protest matters before federal agencies as well as State and Federal Courts including the United States Court of Federal Claims.

In addition to our extensive experience in litigating contract based claims in the construction and real estate fields, we are able to draw upon our substantial experience and knowledge in drafting and analyzing complex contracts for a variety of corporate and professional clients in the government contract arena.

A few of the more recent government contract cases we have litigated are as follows:

• Recently, we represented a major design firm that had been awarded the design contract for a monumental government project with an estimated cost of construction of over $120,000,000. During the performance of the contract, the government terminated the client for cause. Subsequently, we filed an action in the United States Court of Federal Claims against the government for wrongful termination. Through our successful litigation efforts, we were able to obtain a conversion of the termination for cause to a termination for convenience and other benefits for our client.

• In the past year, we successfully represented a professional design firm who was awarded a multi-year, multi-million dollar contract with a Maryland County Government. Subsequently, a losing bidder challenged the award of that contract through the Bid protest process. Later, we joined the County Government attorneys in successfully defeating the losing bidders claim in the State Circuit Court and at the Appellate level.

In our practice, we assist clients in reviewing Government contracts prior to execution; advising clients during contract negotiations; and, providing counsel if disputes or other issues arise during the performance of those contracts. Our goal is to try and assist clients in avoiding the risk of costly and time-consuming disputes. If disputes arise, however, we have the experience to help them defend their corporations and organizations in the most effective and expeditious manner possible.
